Sub:     Licence Fee  to Phonographic Performance Limited (PPL)
 for the special events  - X-mas  and New Year Eve

Dear Sir/Madam

As you are aware, all hotels and restaurants who were holding special events on X-mas and New Year Eve are paying licence fee as per the tariff announced by PPL in  2004. In 2005-06 the tariffs were paid on the basis of   2004 plus 15% increase  (copy enclosed).

Now PPL had filed an application which was listed for hearing in the High Court of Delhi on 7th December, 2007, in which they have requested the Hon’ble Court to vacate the Interim Order of 19th December, 2005   which was obtained by FHRAI.The purpose behind this move is that PPL will be free to charge the tariff announced by them in 2007 which is exorbitantly high.

The Hon’ble High Court of Delhi has directed FHRAI to submit the list of all the Hotels and Restaurants  who will be  holding special  events  on these days on or before 15th December, 2007. These hotels will be allowed to pay the licence fee to PPL based on the tariff existing in 2004 plus 15%.  Others will have to pay licence fee as demanded by PPL.    

You are therefore requested to kindly send us the details by return email/fax whether you are holding any of the Special Event on these days to enable us to   include you name  in the list which is to be submitted to the High Court of Delhi .
The Hotel and Restaurant members who have their Corporate /Head offices outside the hotel/restaurant premises, are requested to inform their Corporate/Head offices accordingly.

Please treat this as immediate and most urgent and send your reply by return email/fax.

Sub:             Licence fee to IPRS for Special Events

 

Dear Sir/Madam,

 

 

I am enclosing  a copy of the letter received by us from M/s Bhasin & Co. regarding the licence fee payable to Indian Performing Right Society Limited (IPRS) which is self explanatory.   Kindly ensure the directions of the Court are followed.

 

As regards the demand raised by other societies if any, no relief can be sought for them from the Hon’ble Court  at present   since these other societies are not a party of the aforesaid petition.   In view of the above, please do not use the sound recordings of the other societies /companies.
