Subject:  GOOD NEWS!!! - TDSAT confirms TRAI tariff for Hotels / Restaurants at par with Ordinary (Domestic) Subscribers .

 We are pleased to inform all members that the Hon TDSAT has dismissed the appeals filed by Broadcasters against the TRAI Tariff orders bringing cable TV charges for Hotels / Restaurants at par with Ordinary consumers / domestic consumers. Members may recall that cable TV tariff for Hotels (above 3 star category & more than 50 rooms), was subjected to higher differential tariff in the past.

 The Hon TDSAT has held that TV Sets in Hotel rooms / Restaurants are part of the amenity provided to the guests at no additional cost and thus Hotel / Restaurants cannot be treated as Commercial consumers.  The Hon TDSAT has upheld the TRAI definition of Commercial subscriber as one who provides cable TV programmes for a fee / additional charges. Thus, it has confirmed the TRAI Tariff order whereby Hotels / Restaurants are to be treated as Ordinary Subscribers to pay cable TV charges at par with what is payable by domestic consumers. 

This is the third round of litigation in the cable TV matter that FHRAI has succeeded in its demand for non discriminatory tariffs for Hotels / Restaurants,
